1. About this policy

Porch Swing Homes ("Porch Swing Homes," "we," "us," or "our") builds and sells new construction homes in Northwest Florida. This Privacy Policy explains what personal information we collect through our website at www.porchswinghomesfl.com (the "Site"), how we use and share it, and the choices you have.

By using the Site, you agree to this policy. If you do not agree, please do not use the Site.

2. Information you give us

We collect information you choose to provide, including:

  • VIP list and newsletter signups. First name, last name, and email address when you join our VIP list to receive community and availability updates.

  • Inquiries and contact requests. Your name, email address, phone number, and anything you tell us in a message — for example, the community, floor plan, price range, or timeline you are interested in.

  • Home tour scheduling. When you book a tour through our online scheduling tool, we receive your name, email address, phone number, and appointment details.

  • Buyer and homeowner information. If you move forward toward a purchase, we collect information needed to do business with you — such as your mailing address, selections and options, closing details, and warranty or service requests after you move in.

  • Financing-related information. If you ask us for a lender referral, we collect the contact information needed to connect you. We do not collect your Social Security number, credit report, bank statements, or income documentation through the Site. That information goes directly to your lender under the lender's own privacy policy.

Please do not send us sensitive personal information (such as Social Security numbers or financial account numbers) by email or through Site forms.

3. Information collected automatically

When you visit the Site, some information is collected automatically through cookies and similar technologies:

  • Device and usage data. IP address, browser type, operating system, device type, referring website, pages viewed, links clicked, and the dates and times of your visits.

  • Google Analytics 4 and Google Tag Manager. We use Google Analytics to understand how visitors find and use the Site.

  • Meta Pixel. We use the Meta (Facebook and Instagram) Pixel to measure the performance of our advertising and to show ads to people who have visited the Site.

  • Squarespace. Our Site is hosted on Squarespace, which sets cookies necessary to operate the Site and collects standard server log information.

  • Google reCAPTCHA. We use reCAPTCHA to protect our forms from spam and abuse. Its use is subject to Google's Privacy Policy and Terms of Service.

  • Scheduling tool. Our tour scheduling is embedded from a third-party provider, which may set its own cookies when you interact with it.

Our Site does not currently respond to "Do Not Track" browser signals. Where required by applicable law, we honor Global Privacy Control (GPC) signals as opt-out requests.

4. Information from other sources

We may receive information about you from:

  • Advertising and social platforms (such as Meta), when you respond to one of our ads or submit a lead form on their platform.

  • Real estate agents and brokers who refer you to us or represent you.

  • Lenders, title companies, and closing agents involved in your transaction.

  • Publicly available sources, such as county property records.

5. How we use your information

We use personal information to:

  • Respond to your questions and provide information about our homes, communities, floor plans, and pricing;

  • Schedule and conduct home tours and follow up afterward;

  • Send you community updates, availability notices, and marketing messages you have asked to receive;

  • Prepare, negotiate, and complete a home purchase, and coordinate closing;

  • Provide warranty service and homeowner support after closing;

  • Operate, secure, troubleshoot, and improve the Site;

  • Measure and improve our advertising, including showing ads to people who have visited the Site;

  • Keep records, and comply with law, contracts, building codes, and permitting requirements; and

  • Detect and prevent fraud, abuse, and security incidents.

A note on housing advertising. Housing is a protected category under fair housing law. We run our real estate ads under the special ad category restrictions the advertising platforms apply to housing, which limit how narrowly housing ads can be targeted.

6. How we share your information

We do not sell your personal information for money. We share it only as described here:

  • Service providers. Companies that perform services for us — website hosting, email and CRM platforms, scheduling, analytics, advertising, and document management. They may use your information only to provide services to us.

  • Transaction partners. When you are buying a home, we share information as needed with lenders you choose, title and closing agents, surveyors, inspectors, appraisers, insurers, and homeowners' or community associations where applicable.

  • Trade partners. Subcontractors, suppliers, and warranty providers who need your address and scheduling details to perform work at your home.

  • Advertising and analytics partners. As described in Section 3, our use of analytics and advertising cookies means certain identifiers and browsing activity are shared with Google and Meta. Under some state privacy laws, this may be considered "sharing" or "targeted advertising" even though no money changes hands. You can opt out as described in Section 7.

  • Legal and safety. When we believe disclosure is required by law, subpoena, or court order, or is necessary to protect our rights, property, or the safety of others.

  • Business transfers. In connection with a merger, acquisition, financing, or sale of all or part of our business.

7. Your advertising and cookie choices

You can limit tracking in several ways:

  • Browser controls. Most browsers let you block or delete cookies through their settings. Blocking some cookies may affect how the Site works.

  • Google Analytics. Install the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.

  • Google ad personalization. Adjust your settings at myadcenter.google.com.

  • Meta. Adjust your ad preferences in your Facebook or Instagram account settings.

  • Industry opt-outs. Visit optout.aboutads.info (DAA) or optout.networkadvertising.org (NAI).

  • Mobile devices. Use your device's "Limit Ad Tracking" or "Opt out of Ads Personalization" setting.

8. Emails, calls, and text messages

Email. If you join our VIP list or ask to hear from us, we will send you marketing emails. Every marketing email includes an unsubscribe link. You may also email info@porchswinghomesfl.com to be removed. We may still send you non-marketing messages about a transaction or warranty matter.

Calls and texts. If you give us your phone number and consent to be contacted, we or our agents may call or text you about homes, communities, appointments, and your transaction — including through automated systems. Consent to receive marketing calls or texts is not a condition of purchasing any home. Message and data rates may apply, and message frequency varies. Reply STOP to any text to opt out and HELP for help. You can also ask us to place you on our internal do-not-call list by emailing info@porchswinghomesfl.com or calling (850) 704-9096.

9. How long we keep information

We keep personal information for as long as needed for the purposes described in this policy. Inquiry and marketing records are generally kept while you remain interested and for a reasonable period afterward. Records connected to a home purchase, construction, warranty, permitting, or accounting are kept significantly longer, because building and real estate records must be retained under contract, warranty, insurance, and Florida law — including statutes of repose that apply to construction defect claims.

10. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No website, email system, or method of transmission is completely secure, and we cannot guarantee absolute security.

11. Children

The Site is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us at info@porchswinghomesfl.com and we will delete it.

12. Links to other sites

The Site links to third-party websites and tools, including lenders, scheduling tools, and social media pages. We are not responsible for their privacy practices. Review their policies before providing information.

13. Your privacy rights

Depending on where you live, you may have the right to request access to the personal information we hold about you, request correction or deletion, receive a copy in a portable format, opt out of targeted advertising, or appeal a decision we make about your request.

Florida residents: the Florida Digital Bill of Rights applies only to businesses meeting revenue thresholds that Porch Swing Homes does not meet, so it does not currently apply to us. Even so, we will honor reasonable access and deletion requests from any customer or prospect, regardless of where you live.

To make a request, email info@porchswinghomesfl.com with "Privacy Request" in the subject line, or call (850) 704-9096. We may need to verify your identity before responding, and we may decline requests where an exception applies — for example, where we must retain records for a construction, warranty, tax, or legal purpose. We will not discriminate against you for exercising these rights. An authorized agent may submit a request on your behalf with proof of authorization.

14. Visitors from outside the United States

We operate in the United States, and any information we collect is stored and processed here. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.

15. Changes to this policy

We may update this policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be highlighted on this page. Your continued use of the Site after an update means you accept the revised policy.
