Agreement to these Terms. These Terms of Service ("Terms") govern your use of the website at www.porchswinghomesfl.com (the "Site"), operated by Porch Swing Homes ("Porch Swing Homes," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. These Terms govern your use of the Site only. They are not a contract to build, buy, or sell a home. Any home purchase or construction agreement is a separate written contract signed by both parties, and that contract controls.

Information on this Site is not an offer. Floor plans, renderings, elevations, square footages, dimensions, features, finishes, lot availability, community details, delivery timelines, and prices shown on the Site are for general information only. They are subject to change without notice and do not constitute an offer to sell or a guarantee of availability. Renderings and photographs are illustrative, and actual homes may differ in elevation, materials, finishes, landscaping, and dimensions. Square footages are approximate and may be measured by methods that differ from those used by an appraiser or taxing authority. Nothing on the Site should be relied on as a substitute for a signed purchase agreement, a recorded plat, a survey, or your own inspection.

Pricing and availability. Prices shown are base prices. Unless expressly stated otherwise, they exclude lot premiums, options, upgrades, closing costs, and any association or municipal fees, and they may change at any time. A home is not reserved until a written purchase agreement has been executed and any required deposit received.

Financing. Any reference on the Site to lenders, loan programs, rates, payments, or incentives is informational only. We are not a lender, mortgage broker, or financial advisor, and we do not originate loans or approve credit. Loan terms are set by your lender and are subject to underwriting, appraisal, and credit approval. Please consult a licensed lender about your own situation.

Fair housing. Porch Swing Homes complies with the federal Fair Housing Act and the Florida Fair Housing Act. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected class.

Communications, calls, and text messages. If you provide your phone number and consent, we and our agents may contact you by phone, email, and text message about homes, communities, appointments, and your transaction, including through automated systems. Consent to receive marketing calls or texts is not a condition of purchasing any home. Message and data rates may apply and message frequency varies. Reply STOP to any text message to opt out, and HELP for help. Our handling of your information is described in our Privacy Policy.

Acceptable use. You agree to use the Site for lawful purposes only. You may not scrape, harvest, or copy Site content for commercial use; attempt to gain unauthorized access to the Site or its systems; interfere with the operation or security of the Site; upload malicious code; or use the Site to harass, defraud, or mislead others.

Intellectual property. The Site and its contents, including text, photographs, renderings, floor plans, logos, and the Porch Swing Homes name and marks, are owned by Porch Swing Homes or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages for your own personal, non-commercial use. All other use requires our prior written permission.

Third-party links and services. The Site links to and embeds third-party services, including scheduling tools, chat and messaging tools, analytics, advertising platforms, and lender and partner websites. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.

Reviews and testimonials. Testimonials on the Site reflect the experience of the individuals who gave them. They are not a guarantee that you will have the same experience.

Disclaimer of warranties. The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on the Site is complete, accurate, or current. This section applies to the Site only. It does not limit, waive, or affect any warranty that applies to a home under a signed purchase agreement, a written limited warranty, or Florida law.

Limitation of liability. To the fullest extent permitted by law, Porch Swing Homes and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of or inability to use the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). This section does not limit any liability that cannot be limited under applicable law, and it does not apply to obligations under a signed purchase agreement.

Indemnification. You agree to indemnify and hold harmless Porch Swing Homes from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms or applicable law.

Governing law and venue. These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Bay County, Florida, and you consent to the jurisdiction of those courts.

Changes to these Terms. We may update these Terms at any time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after an update means you accept the revised Terms.
